DC Shoes 2009 Rally America Photo Contest Rules


Eligibility

The contest is open to legal residents of the United States (excluding Puerto Rico). Must be 14 years of age to enter. Void where prohibited by law. Rally America employees, photo contest judging panel, contest sponsors, Rally America accredited media card holders, Rally America event organizers and their immediate family members are not eligible to enter. Entrants are subject to all applicable federal, state and local laws. An individual may submit only one photograph per contest.

Agreement to Official Rules

By participating in this contest, entrants agree to abide by the terms and conditions of these official Rules as established by Rally America.

How to Enter

Entrants may enter by opening a photo contest account at www.rally-america.com/contests/. Name, address, telephone number, email address and age of the entrant are required when opening an account. Entries submitted without complete identifying information are not eligible to win. Rally America will protect the privacy of the account holder and will not sell or supply this information to third parties.

All entrants represent and warrant that they are the author of the photograph submitted in connection with the contest and that the use of the photograph by Rally America as provided herein will not infringe or misappropriate any intellectual property, rights of publicity, or other proprietary rights of any person or entity.

Photo Formats

  • Entries may be color or grayscale digital images.
  • Entries must be submitted to the Rally America photo contest in accordance with the following specifications:
  • Minimum Resolution: 2000 pixels in width or length.
  • Maximum Resolution: 4,000 pixels in width or length (approximately 2.5 to 10 megapixel cameras).
  • Format: JPEG only in RGB color format.
  • File Size: No larger than 5 Megabytes.

Image Modifications:

Color correction and other digital enhancement is permitted, however significant manipulation or modification of an image may result in the disqualification of that image.

Not Permitted:
  • No borders or frames may be added to images.
  • No watermarks, signatures, or copyright notices may be added to images. All winning images will be displayed with the photographer's name.
  • Adding or replacing elements in an image is not permitted.
  • Artistic filters are not permitted.
Permitted Modifications:
  • Images may be cropped and rotated as necessary as long as the rectangular format is maintained and the size is within the specifications above.
  • Images may be resized as long as the aspect ratio is maintained
  • Red-eye removal and spot editing
  • One-step enhancement (such as "AutoFix", "QuickFix", "Auto Levels", etc.)
  • Use of filters to sharpen, soften, blur, despeckle, or remove noise.
  • Use of corrective functions to improve the natural appearance of the image, such as levels, contrast, brightness, curves, intensity, tone, hue, saturation, lightness, value, color balance, and tint.

Use of Entries

No entries will be returned. All entries, excluding the photographs submitted in connection therewith, become the property of Rally America. By entering, all entrants consent to the use by Rally America of all the information provided in the entries, including but not limited to for marketing or sales promotion purposes without any attribution, identification, right of review or compensation to entrants, excluding the photographs.

All photographs submitted in connection with the contest shall remain the property of the entrants, although Rally America may retain print and electronic copies of the photographs in perpetuity if it chooses to do so. Rally America shall not be required to maintain or return to entrants any photographs submitted to it in connection with this contest. By entering this contest, entrants agree to grant to Rally America the non-exclusive, non-transferable, worldwide, perpetual right to publish, copy, exhibit, transmit, perform, broadcast or otherwise use the photographs by any means and in any media, whether now known or hereafter developed, for any and all purposes, without payment of further consideration to entrants.

Use of submitted materials will be accompanied by proper credit to the entrant. The entrants' emails will be stored by Rally America. Rally America strictly protects the privacy of the entrants and will not sell or disclose personal information to any third parties.

Entry Period

Contest participants may enter one (1) photo per Rally America national championship event.

Photo submissions begin February 1, 12:01am and ends February 6, 9:00pm

Voting Period

Only one (1) photo per user account is allowed per week.

Judging and Selection of Prize Winner

The entries will be prescreened through a subjective process in which Rally America will decide which of the entries it receives best comport with the purposes of the contest and have the greatest amount of consumer appeal before being posted for voting on its website. Fans will be given the opportunity to select 10 photographs for weekly prize judging. The panel of judges is predetermined and will select the overall winner based on creativity, photographic quality, and effectiveness conveying rally car action. In the event that similar entries are submitted by multiple entrants, Rally America reserves the right to choose the finalists based on the criteria listed above. The odds of being selected as a finalist or winning are not capable of being calculated due to the uncertainty over the number and quality of entries received.

Each weekly winner of the DC Shoes/Rally America 2009 photo contest will advance to the grand prize round. The judging panel will select the grand prize winner from the pool of weekly winners.

Prize

Rally America national event photo contest winner will receive a pair of DC Shoes and an autographed poster from Ken Block (Monster World Rally Team). Prize is valued at $100. The prize winner will be notified by DC Shoes of what items are available to choose from.

Taxes, if any, are the sole responsibility of the Prize Winner. Rally America makes no warranties or disclaimers concerning the Prize beyond those customarily given by the manufacturer of the Prize. Rally America reserves the right to substitute a different Prize of approximately equivalent value in its sole discretion.

Notification of Prize Winner

Winner will be notified by email or phone call within 7 days of the selection date and will be contacted for further information. If the Prize Winner does not acknowledge acceptance of the prize within 7 after being notified that he or she is the Prize Winner or does not abide by the requirements of Prize Winner specified below, another Prize Winner will be chosen using the same procedure specified above. The prize shall be delivered to the Prize Winner at the address listed on his or her entry form. The Winner's photograph will be displayed on the Rally America homepage.

Requirements of Prize Winner

Rally America may, within its sole discretion, require the Prize Winner to sign and return an affidavit of eligibility and liability and publicity release, in which the Winner consents to the use of his or her name, age, hometown and photo by Rally America for advertising and promotional purposes, without any additional compensation, wherever lawful, as a precondition to award of the Prize. If the Prize Winner fails to sign and return the requested affidavit of eligibility and liability/public release as requested by Rally America, that Winner may be disqualified, and the Prize will thereafter be awarded to an alternate Winner from the remaining valid entries using the criteria specified above. In addition, Rally America may require a parent or legal guardian of a Winner under the age of majority as defined in the jurisdiction where the Winner resides to execute an agreement acknowledging the efficacy of the contest rules to the minor Winner as a precondition to the award of the Prize.

Additional Information

Rally America is not responsible for computer system, hardware, software or program malfunctions or any other errors, failures, or delayed computer transactions or network connections that are human or technical in nature. Rally America is not responsible for misdirected, misplaced, illegible, unintelligible, incomplete, or late entries or (ii) any act, failure to act, or delay regarding the transmitting or processing of entries. Rally America reserves the right to cancel or suspend all or any portion of the photo contest without notice. Rally America is entitled to interpret these rules as needed and its decisions are final. Rally America reserves the right to disqualify any entrant that is believed to be not the original work of the entrant, or does not meet the contest rules. If a winner is disqualified or determined ineligible, an alternate winner will be selected using the same judging criteria.

Release and Publicity

By participating in the contest, you agree to release and hold harmless Rally America and its employees, officers, affiliates, agents, and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your participation in this contest, including infringement of intellectual property rights. Rally America and its employees, officers, affiliates, agents, and advertising and promotional agencies assume no responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind arising in whole or in part from this contest.

Contest Results and Official Rules
